This is a contract for personal photography services to be provided by Jules Morgan Photography. You agree to the following terms and conditions:
RETAINER
A 50% retainer fee of your chosen coverage is required to hold the date of your event. No date is reserved • until a retainer is received. The balance of the complete package price must be paid at least 7 days prior to the event. If final payment is not received, Jules Morgan Photography will not be expected to attend said event. Additional custom orders (reprints, enlargements, albums) must be paid in full at the time of order.
CANCELLATION
Upon acceptance of these terms, Jules Morgan Photography reserves the time and date for Client and will • NOT make any other reservations for that time. For this reason, the retainer is non refundable, even if Client cancels the order for photography, or changes the date of the event.
However if Jules Morgan is able to contract another event of at least equivalent value for the cancelled date, • the retainer will be refunded. The Jules Morgan warrants that in the event of a cancellation, reasonable effort will be made to secure a replacement assignment.
FAILURE TO PERFORM
Due to the limited and subjective nature of the event, Jules Morgan Photography can not be held responsible for requested photographs not taken or missed, lack of coverage resulting from weather conditions, or schedule complications caused by but not limited to, anyone in or at the event, or by the church or location restrictions. The photographer is not responsible for lost photo opportunities due to other cameras or flashes, the lateness of the bride, groom, or other principles.
FORCE MAJEURE
If Jules Morgan Photography cannot perform this agreement due to a fire, casualty, strike or other civil disturbances, Acts of God, including but not limited to, road closures, severe traffic, fire, terrorism or other causes beyond the control of the parties, or due to the photographers illness, then Jules Morgan Photography shall return any moneys paid by the client, less expenses, but shall have no further liability with respect to the agreement.
If Jules Morgan is unable to supply the above client with any photos from any coverage due to uncontrollable circumstances such as camera malfunctions, theft, hi-jacking, lab errors or accidents etc, Jules Morgan agrees to provide a refund in the amount for the affected coverage(s).
EVENT FOOD SERVICE
For bookings over 5 hours, please provide a meal for myself and my assistant at your reception. Being a part of the reception also enables more personal photographs from this portion of your wedding.
PRODUCT DELIVERY
Digital proofs will be available online a maximum of 45 days after the wedding day. Your event will be available for online viewing and print ordering for 6 months from the day of your wedding.
Jules Morgan is not responsible for the colour reproduction of enlargements from these files that have been taken to non-professional and/or consumer type labs.
Prices include VAT. Prices for shooting fees are guaranteed until your wedding day. Print prices are guaranteed for one year from the day of your wedding.
Delivered proofs contain digital edits made at the studio’s discretion, as we wish to deliver only the highest quality product to the client at all times.
EXCLUSIVE PHOTOGRAPHER
Jules Morgan Photography shall be the exclusive photographer retained by the client for the purpose of photographing the wedding. It is also recommended that family and friends not photograph the actual shots that Jules Morgan poses and the contracted party understand that Jules Morgan is not responsible for the final results are any photos missed as a result of this interference during the photography process.
EXPENSES
Additional expenses are negotiated on an individual basis. A hotel room is provided for Jules Morgan and her assistant if the travel is over 2 hours and dependant on the scheduled times in which the contract begins. Flight and hotel arrangements will be made by Jules Morgan and will be charged to the customer as specified on this contact, if scheduled to shoot in a location that requires travel arrangements of this type. Any further details in relation to travel, if necessary, will be itemised and attached as an addendum to this contract.
CREATIVE LICENSE
Images are edited at the photographer’s discretion, and delivered prints may not include all images shot. The photographer reserves the creative right to edit and release only those deemed creditable as professional in quality and within the photographer’s artistic standards. Jules Morgan Photography is a non-traditional photographer and does not work from detailed ‘shot lists’, except in relation to family photos only, as specified below. Jules Morgan’s approach to your day is contemporary and creative. As such, I work in a free-flowing manner to provide you with photos that best represent my style. If there are special details you’d like me to look out for, please let me know and I will do my best to capture these with the available time and conditions.
FAMILY PHOTOS
To accommodate your family photos efficiently, please provide Jules Morgan wih a list of members in your immediate family that will be included in the family photos, i.e. parents, siblings and grandparents. It is highly recommended that if you have groups of individuals that are beyond your ‘immediate family’, that you provide a more specific list of these groups. It is also recommended that you appoint someone who knows your family to help out with rounding up people for the family shots.
PHOTOGRAPHIC TIME
The booking parties should attempt to provide Jules Morgan Photography with adequate time to perform the photo shoot portion of the timeline to accommodate the family photo list and the wedding party/bride and groom shots. I recommend a timeline of a minimum of 60 minutes to complete these photos. Jules Morgan Photography cannot be held responsible for timelines that do not run on schedule and subsequently cut down the time for allotted photos, thereby not providing the couple with all photos expected. Jules Morgan Photography will also not be responsible for photos that are not completed due to the possibly uncooperative nature of the individuals to be included in any photographs. It is the couple’s responsibility to inform all participating parties, that the photos are occurring and as to where and when.
ALBUM DESIGN
Clients will be asked to select up to 60-80 images for their album. Based on the number of pages in the album selected in your package, not all images selected will be put in the album. The number of images put in the album will be between 50-100, and will vary by design of the album.
ALBUM DELIVERY TIME
As some of the albums are imported internationally, album delivery is 6-12 weeks from time images are submitted. Due to the fact that printing and production is outside the control of Jules Morgan Photography, the client will not hold Jules Morgan Photography responsible for late or delayed albums.
SUBSTITUTION
In the event of extreme illness or sudden emergency out of the control of both parties, Jules Morgan Photography will attempt to substitute a photographer at no cost to client. This contract will be transferable to said Photographer.
CD/DVD STORAGE
Ownership of the high resolution digital files (negatives) is included with this package and you agree to assume full responsibility for the care and condition of the CDs/DVD’s. Due to the lack of information about how long CDs/DVDs can hold information, Jules Morgan Photography recommends you back up your images on another media format other than CD/DVD. Jules Morgan Photography also recommends making multiple copies of CDs/DVDs every year to insure the images for years to come. Jules Morgan Photography can not be held responsible for the failure of CDs/DVDs due to mishandling. It is the client’s responsibility to keep several copies of any CDs/DVDs in more than one location, and back the images up on another format such as a hard drive.
CLIENTS PERMISSION AND RESPONSIBILITY
I kindly ask that you get in touch with me two weeks prior to the date of your event, To touch base and go over last minute details. I will make every effort to contact you, but it is the clients’ responsibility to contact me to confirm all events and times.
Permission is herby granted to Jules Morgan Photography to use any images created under this contract for professional samples, displays, internet website pages, advertising, exhibitions, contests, and any other purpose.
The client understands the images given on CD/DVD can not be used for profit or advertising and all posting of images on the internet need to be acknowledged as images by Jules Morgan Photography.
